Ordinance No. 5954

5954 - AN ORDINANCE relating to vehicles; regulating stopping, standing, and parking; and creating a Union Neighborhood Parking Zone together with additional regulations governing it; and amending Section 10.16.055 of the Olympia Municipal Code.



THE OLYMPIA CITY COUNCIL ORDAINS AS FOLLOWS:

Section 1. That Section 10.16.055 of the Olympia Municipal Code and Ordinances pertaining thereto are hereby amended to read as follows:

10.16.055 Exemptions to Section 10.16.050 in certain areas Residential Parking Zones.
A. For all streets lying south of the State Capitol Campus and between Interstate 5 and Capitol Lake, and for all streets lying between Capitol Way and Plum Street, and for Olympia Avenue lying between East Bay Drive and Puget Street, Quince Street between State Street and Prospect Street, Eastside Street between State Street and Olympia Avenue, with the exception of Capitol Way between 11th Avenue and 14th Avenue, the following exemptions from OMC 10.16.050 shall apply:
A 1. The city manager shall establish methods and procedures to implement the provisions of this section. The methods and procedures shall be designed to provide parking time limit exemptions to South Capitol residents and residents of other streets named above in an efficient and equitable manner in accordance with all applicable laws.
B 2. No person shall stop, stand or park any vehicle on the streets within any of the residential parking zones created by this chapter for a period of more than one hour, or as indicated for a particular street in Section 10.16.050, between the hours of eight a.m. and five p.m. Monday through Friday, except holidays, and except as may be provided for resident and visitor parking set forth by this chapter.
C 3. Any person who establishes that he/she resides in a residential parking zone herein created may apply to the department of public works, parking management division, for exemption of each vehicle registered in her or his name. That person may thereafter park any such vehicle in any legal on-street parking space located within the applicable resident parking zone without complying with applicable time limits established by this chapter or other sections of the Olympia Municipal Code. In addition, any such person may similarly apply for temporary visitors' exemption for vehicles of any persons visiting his or her home. This exemption shall be valid for the established time period with a limit of two weeks. Exemption for vehicles registered shall be valid only for so long as the person named therein remains the registered owner of the vehicle and so long as that person remains a resident of or visitor to the applicable resident parking zone.
D 4. Intermediate Area Residents. Any person who establishes that he/she resides in the area adjacent to the central business district which is metered, known as the intermediate area, may apply to the department of public works, parking management division, for residential exemption allowing him/her to park without time restriction or payment, at the nearest nine-hour metered area. Only one vehicle may be registered per adult. Exemption for vehicles registered shall be valid only for so long as the person named therein remains the registered owner of the vehicle and so long as that person remains a resident of or visitor to the applicable zone.
B. Union Neighborhood Parking Zone. The Union Neighborhood Parking Zone is defined as the area between and including 8th Avenue and Union Avenue, lying between but not including Washington Street and Jefferson Street. With respect to the residents who live within the Union Neighborhood Parking Zone, the following provisions, in addition to those set out in A above, apply:
1. Residents may park without time restrictions or payment at nine-hour meters or two-hour timed parking in that area.
2. Only one vehicle may be registered per adult with a limit of four per household; provided, however, no boats, trailers, or vehicles which exceed the size of a parking stall shall be registered.
3. The registered vehicle must be moved at least once every five days.
4. Vehicles must be currently licensed and operable.
5. Parking privileges created in this subsection shall not apply outside of the area defined in this subsection.

Section 2. If any provision of this ordinance or its application to any person or circumstances is held invalid, the remainder of this ordinance, or application of the provision to other persons or circumstances, shall be unaffected.
